These terms govern your use of BackPain (“the app”, package soy.gabimoreno.backpain), operated by Gabriel Moreno Ibarra. By installing or using the app, you accept them. If you do not agree, please do not use the app.
What BackPain is, and what it is not
BackPain is a wellbeing app. It looks at a photo you provide, gives you an orientative posture score, and suggests a short daily mobility routine.
BackPain is not a medical device. It does not diagnose, treat or cure any condition, and it does not replace the advice of a health professional. The score is orientative, not a clinical assessment. If you are in pain, or you have any medical condition that affects your movement, see a healthcare professional before following any routine. You use the exercises at your own risk, and you should stop if anything hurts.
Who can use the app
The app is not directed to children. You must be old enough to enter into a contract in your country to buy a subscription.
Your account
You can use the app without an account. Signing in is optional and only exists so your answers follow you if you change phone. You are responsible for what happens under your account and for keeping access to it secure.
Subscriptions, free trial and billing
- Full access to BackPain requires a paid subscription, sold through Google Play.
- If a free trial is offered, its length is the one shown on the subscription screen at the time you subscribe. If you do not cancel before the trial ends, the subscription starts and you are charged.
- Subscriptions renew automatically at the price and period shown at purchase, until you cancel.
- You can cancel at any time from your Google Play subscriptions page. Cancelling stops the next renewal, and you keep access until the end of the period you already paid for.
- Prices are shown in your local currency and may change. Any price change applies to future renewals and is notified in advance, as Google Play requires.
Refunds
Purchases are processed by Google Play, so refunds follow Google Play’s policy and are requested through Google Play. If you think something went wrong with a charge, write to soporte@gabimoreno.soy and we will help where we can.
What you may and may not do
You get a personal, non-transferable licence to use the app on your own devices. You may not copy, resell, rent, reverse engineer or extract the app’s content, nor use it in a way that breaks the law or interferes with the service.
Content and intellectual property
The app, its content, its exercise routines and its brand belong to Gabriel Moreno Ibarra and are protected by copyright. Your photos and your scan results are yours; as explained in the privacy policy, photos are processed on your device and are never uploaded.
Availability and changes
We may add, change or remove features, and we may stop offering the app. If the app is discontinued, subscriptions already paid for will not be renewed and you will be able to request a refund of any unused paid period through Google Play.
Termination
You can stop using the app at any time by uninstalling it and cancelling your subscription. We may suspend access if these terms are broken.
Liability
The app is provided as it is. To the extent the law allows, we are not liable for indirect or unforeseeable damages arising from your use of the app. Nothing in these terms limits rights that consumer law gives you and cannot be waived, including liability for death or personal injury caused by negligence.
Changes to these terms
If these terms change, the “last updated” date above will be revised. Continuing to use the app after a change means you accept the new terms.
Governing law
These terms are governed by Spanish law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of your place of residence.
